ok i been through this with friends, read the rules and still im confused. lemme explain.
ive used the T-formation (as described on this forum) with an independent commi as an 11th man (8/1/1/1 formation) and came across a lil hic-up.
when i came to break (which i did) i had commi +1 model left out of the enemy kill zone. when i broke, commi executed trooper and passed test as per rules. now here it gets interesting.
as the commi is now alone, and squad dead he reverts to being independent and a unit unto himself.
as the commi executed the last member of the squad AFTER combat res calculated its not classified as a massacre.
does the enemy now consolidate 3" (for killing target unit off as commi is now in his own unit) or...
does the enemy pill into him?
i was thinking the former as commi was not in combat per-se being 4.5 inch away from enemy and is a different unit now to the one the enemy was killing? do i have this right?

The Commissar has to be attached to the squad to be able to perform Summary Execution. Therefore, regardless of where he is in relation to enemy after resolution, they would pile in to him as he is considered to be in the same assault. Dont get hung up on how far away he is. What matters is whether he was part of the same assault or not, which he was as he was attached to the squad. Also, Independant Commissars are always ICs, even when attached to a squad. They are considered seperat units for attacks and wounds suffered, but are still considered to be part of the same assault as the squad they are attached to.

but the thing thats getting me is that hes "attached to the squad" untill it dies upon which he reverts to being an independent Character" as he executed the last man in squad he cant be part of that squad anymore as the squad is dead. and i was under impression you cant pile into a new unit only consolidate?

Like Angelusmortis said. He was in the same CC before the squad died. So now he is still in CC with the opponents, just without his squad. The important part is that he was attached to a unit in CC. After the extermination of that squad the opponents just attack the last remaining 'member' of that squad, which is the commissar
